A further appeal Sainsbury application in Ilford Town Centre

 I make the argument in a the committee to be re-run for the reasons below: I will publish the reply in due course.



Dear Redbridge Planning Officer

 

I wish appeal against the decision made by the planning committee for the Sainsburys Development per the attached letter which gives you as a contact for a further appeal.

 

My grounds are that public confidence in our local democracy will be damaged if the committee's decision is not rerun. The Chair said all the evidence should be heard, but he talked over a member of the public when she was giving her evidence. While he apologised for this conduct to Linda Speedwell, he erred by not asking her to give her evidence again.

 

Secondly, Redbridge appear to concede that the borough lawyer erred in law by wrongly telling the Councillors that the NHS was not a material consideration in reply to Paul Scott's question. 

Finally, and to be clear, I am not threatening legal action here, but the nonetheless the  Council appears subject to judicial review on both of the points above because the committee did not provide a fair trial to the residents. 

Should the  judicial review occur it would cause the developer and  the council costs and a delay. I do not know Ms Speedwell & Mr Scott's financial circumstances, but they may be  eligible for legal aid. 

 

Therefore, the comparatively slight cost and slight time delay of re-running the committee  in contrast with the longer delays and costs of a potential judicial review  makes a compelling argument for you to re-run the committee again.
