Tesco must intervene over unlimited costs application
Both Weston and Redbridge Council agree that this is an Aarhus
claim which means costs are limited to £10,000 for an organisation. Four of us
put in the Stop the Tesco Toxic Towers objection paper before the planning
committee meet. This paper features in our arguments at court.
Unfortunately for us, the rules of the costs cap have been
changed against claimants and in favour of the government. My wife and I have built up a property
business over a 23 year period and as a consequence of the assets in the
business Weston are arguing their cap should be set at £35,000. This means
should we lose at court I will have to pay Weston £35K
More concerning though is the Council’s decision to pursue
me for unlimited costs. Should we be granted a full hearing at the High Court,
there is the prospect of further litigation at the Court of Appeal and then the
Supreme Court. It will be a challenge for a community group to fund our own
costs; to also find the Council’s unlimited costs plus £35K for Weston would
risk bankruptcy for me so I would have to withdraw on behalf of the group
unless these caps can be reduced.
The costs of opposing the unlimited cap and the £35K cap are
