Our permission hearing for
Judicial Review against the Tesco Toxic Towers takes place on the 14th February.
We hope to get a turnout from supporters outside the court and in the court
room on the day for press photos. If we win it means a full hearing later on
this year. If we lose, providing our barrister says an appeal is reasonable, we
will appeal to the Court of Appeal.
A key issue at the hearing will
be the proposed primary school facing onto the polluting High Road. The flats
adjacent to the school have air filters to the seventh floor to protect
families from toxic air, hence the campaign labelling the development the Tesco
Toxic Towers. However, the proposed school does not have air filters. Redbridge
Council and Weston Homes are opposing Building Bulletin 101 from going into the
court bundle. Redbridge Council approvingly referenced Building Bulletin 101 in
the officer report with regard to ventilation standards to stop the proposed
school from overheating. BB 101 also states Councils must consider air filters
for schools in high pollution areas. The officer report given to Councillors on
the night the Towers were passed failed to mention this requirement for the
Council to consider air filters. Arguably this omission was misleading the
Councillors who made the decision. We do not get the time of the hearing until
the day before. If it is an afternoon hearing, we will switch to a later
