Report from meeting yesterday: Appeal out of time and Homebase
Thank you to everyone attending.
Main news from the legal campaign is our lawyers put in an application for an appeal to the court of appeal, but missed the deadline. The solicitor dealing with our case a serious personal issue which needed attention. Hopefully the court of appeal will allow the out of time extension.
A ruling per the pic was when the court gave 21 days to file. The limit has been changed to 7 days which is tight. I will report more when I have news.
The case law on out of time extensions appears complex to me per the article here https://www.civillitigationbrief.com/2021/11/23/denton-principles-considered-in-application-to-appeal-out-of-time-permission-granted/
We are also discussed dust arising from the Homebase construction site. We heard from two residents in the road complaining about dust and as a consequence I wrote the following email to Cllr Athwal earlier today.
Dear Jas
I wrote to you on 2nd March per the email below.
"Dear Jas
I wrote to you on twitter about Homebase yesterday, I would be grateful if one of your officers could reply. Tweet is below:
Good Afternoon @Jas_Athwal While going door to door yesterday lots of residents are complaining about dust caused by the Homebase construction. Can one your staff send me the dust management plan along with how many inspections have taken place by @RedbridgeLive staff" ENDs email
Yesterday I attended a public meeting at which two residents from Goodmayes Avenue complained about dust coming from the Homebase site. Can I have a reply by the 21st March to my email of 2nd March please?
A resident pointed out that there is a school at 785 Seven Kings High Road and a nursery also on the High Road which means dust prevention from the site must be a priority.
Regards
Andy
