Stop the Tesco Toxic Towers Meeting:
Tonight: 8pm Monday 3rd November at the Methodist Church Hall on Percy Road IG3 8UA
Dear Residents
Thank to everyone who came to the fundraising quiz on 1st November. This email has gone to Mr Lancaster, the head of Planning at Redbridge.
Dear Mr Lancaster
These are my reasons for judicial review. Should our fundraising campaign be successful I would send it to a lawyer in due course. The authority I rely on is Tameside per the attached. I quote from the article:
"The Tameside duty takes its name from Secretary of State for Education and Science v Tameside MBC. As Lord Diplock explained, the duty requires the decision-maker to have ‘[asked] himself the right question and take reasonable steps to acquaint himself with the relevant information to enable him to answer it correctly’. It is most commonly described as a duty to make sufficient or due inquiry. For background reading, see: ‘Due Inquiry’: Supperstone, Goudie and Walker on Judicial Review." Ends quote
My argument is that Redbridge have not asked the right question, which is should the medical facility planned for the Seven Kings Car park development be brought forward to the planned Goodmayes Tesco Development?
 The
"reasonable steps" Redbridge has failed to make include to
monitor the local NHS adequately. It appears that the only key
performance indicator Redbridge uses when monitoring the local plan
is that of square metreage of health facilities.
I would be grateful if you could inform me if the Council will write to Weston Homes and Tesco to ask if their plans can be altered to include a GP facility on the site. I have copied in Wes Streeting MP as if a Judicial Review goes ahead, I expect the NHS to be an interested party to the proceedings. I expect further grounds on the Climate Crisis to follow.

Any challenge will be over the lack of NHS capacity and/or climate change.
